Destiny copyright takedowns aren’t Bungie’s doing, the developer says

Bungie says its own channels are being impacted as well.

A series of Destiny copyright takedowns aren’t happening at the request of Bungie, the developer has today proclaimed.

In recent days, a string of copyright takedowns have impacted high-follower creators such as lore master My Name if Byf. Today, Bungie said some of its own channels are being impacted by takedown notices that “are not being taken at the request of Bungie or our partners.”

“We’re aware of a series of copyright takedowns on YouTube and we’re actively investigating. This includes content on our own Bungie channels,” Bungie said in a tweet. “These actions are NOT being taken at the request of Bungie or our partners. Please standby for future updates.”

Bungie says that it “strongly supports the efforts of our community to produce non-commercial content using video images, footage, music, sounds, dialogue, or other assets from our games, subject to a few conditions.” as part of its IP and trademark guidelines. As lawyer Richard Hoeg points out, Bungie’s guidelines are just that — subject to change and not the same as providing a license to creators to produce their own works. Bungie currently employs an 80-20 rule when it comes to its IP; creators are “generally” free to use audio and visual elements from Destiny provided they’re limited to 80% of the overall work. This all said, these recent copyright takedowns appear to be fraudent; Bungie’s guidelines simply aren’t at play here if true.
