Xbox 360 disc-scratching lawsuit makes a comeback after eight long years

Eight years after it began, an Xbox 360 disc-scratching lawsuit looks set to proceed in the U.S. federal district court.

A motion to reconsider a recent district court decision that overturned a denial of a class-action lawsuit against Microsoft failed, so the suit is back on. Confusing enough for you?

Microsoft can appeal the decision with the U.S. Supreme Court. If an appeal is not made, the lawsuit may become a class action with the federal district court.

The plantiffs in the suit argue that even under normal 360 playing conditions, the console’s disc drive is so sensitive that it spins discs out of control, damaging discs to the point where they become unplayable.

We’ll keep you informed as this progresses.
