Nintendo issues takedown notice for fan-made Super Mario 64 HD

A fan made recreation of Super Mario 64 in HD using Unity has been issued a takedown notice by Nintendo for copyright infringement.

Creator Erik Ross told Eurogamer that “All the art and animations were done by myself, with the exception of the Mario, Goomba, and Power Star meshes, which are ripped (without animations) from Super Mario Galaxy.” Nintendo’s takedown notice reads “Nintendo’s Super Mario 64 video game (U.S. Copyright Reg. No. PA0000788138), including but not limited to the audiovisual work, computer program, music, and fictional character depictions.”

Ross had released the recreation as an in-browser Unity game, and clarified on his blog that he would not be developing it any further.
